These terms are an agreement between you and us. They are not an agreement with Apple — see "Apple's part in this" near the end.
Using Tavo means accepting these terms. If you don't accept them, don't use the app — and if you have already paid, write to us and we will help you get it refunded through Apple.
You need to be at least 13 years old to use Tavo, and at least 16 if you are in a country whose law sets that age for agreeing to this kind of service. If you are under 18, you should have a parent or guardian read this with you.
A task manager for iPhone, iPad and Mac. You write lists, tasks, steps, notes, dates, reminders and tags; Tavo keeps them on your device and in your Tavo account so they are the same everywhere you sign in.
Everything Tavo does is included. There are no tiers, no add-ons and nothing held back to sell you later.
Tavo requires an account, because a list that reaches every device you own has to live somewhere all of them can ask. You can make one with an email address and a password, or with Apple.
You are responsible for keeping your sign-in to yourself. Tell us if you think somebody else has it. One account is for one person — accounts are not to be shared or resold.
You can delete your account at any time from Settings → Account → Delete account. That erases everything in it, immediately, with no recovery period. We will not make you email anybody to do it.
Tavo is sold as a monthly or an annual subscription. The current price is shown in the app before you buy and on the App Store listing, in your own currency.
Apple handles the money. We never see your card, your billing address or your Apple Account details. Refunds are Apple's to give — ask through the App Store, and write to us if that goes nowhere and we will help.
Your lists, tasks, notes and photographs are yours. We claim no ownership of them and no right to use them for anything except running Tavo for you — storing them, showing them back to you, sending them between your devices, and, if you choose to share a list, showing that list to the person you shared it with.
We do not read your content, sell it, advertise against it, or use it to train anything. The one exception is a fault you have reported and asked us to look into, and only as far as looking into it requires.
Tavo is not end-to-end encrypted. We hold the keys to the database your tasks are in, which is described plainly in the Privacy Policy. If that is not acceptable to you, Tavo is the wrong app, and we would rather say so here than let you find out later.
Don't use Tavo to break the law, to store or share material that is illegal, or to harass anybody through a shared list.
Don't try to break into other people's accounts, take the service apart to get at somebody else's data, overwhelm our systems, or work around the payment.
If you share a list with somebody, you are responsible for what you put in it and who you give it to.
We aim to keep Tavo working and available, and we will not pretend to guarantee it. Services go down, Apple changes things, and a one-person operation is a one-person operation.
Tavo is built to keep working when ours doesn't: your tasks are written to your own device first, so the app functions with no connection at all and catches up later.
We may change how features work, and we may retire one. If we ever stop running Tavo altogether, we will give reasonable notice, a way to get your data out, and a refund of the unused part of any subscription.
You can stop at any time: cancel the subscription in your Apple Account settings, delete your account in Settings → Account, and delete the app. Deleting your account erases what it held.
We can suspend or end an account that is being used to break these terms — in practice, for the things under "Using it properly" — and we will tell you why unless telling you would be unlawful. If we end your account for a reason that isn't your doing, we refund the unused part of your subscription.
Tavo is provided "as is" and "as available", without warranties of any kind beyond those the law insists on. We do not warrant that it will be uninterrupted, error-free, or that it will never lose anything.
Tavo is a task list, not a system of record. Don't rely on it alone for something whose loss you couldn't live with — keep your own copy of anything that matters that much.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If you are a consumer, your statutory rights are unaffected by anything here.
Beyond that, and to the fullest extent the law permits: we are not liable for indirect or consequential loss, for lost profits or lost opportunities, or for data you lost that you had no other copy of. Our total liability for any claim is limited to what you paid us in the twelve months before it arose.
These terms are between you and us. Apple is not a party to them.
Apple has no obligation to provide any support or maintenance for Tavo. If Tavo fails to conform to any warranty, you may tell Apple and Apple will refund the purchase price; beyond that, Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform are ours rather than Apple's.
We, not Apple, are responsible for addressing any claim you or a third party makes about Tavo — including product liability claims, any claim that Tavo fails to meet a legal or regulatory requirement, and claims under consumer protection or similar law. We, not Apple, are responsible for investigating and defending any claim that Tavo infringes somebody's intellectual property.
You confirm that you are not in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these terms and have the right to enforce them against you.
These terms are governed by the law of the State of Arizona, United States of America, and disputes go to its courts.
If you are a consumer living somewhere else, this does not take away the protection of your own country's mandatory consumer law, or your right to bring a claim where you live.
If any part of these terms turns out to be unenforceable, the rest still stands.
Not enforcing something straight away doesn't mean giving it up.
You may not transfer your rights under these terms to somebody else. We may transfer ours if Tavo changes hands, and we will tell you if that happens.
These terms and the Privacy Policy are the whole agreement between us about Tavo.
We may update these terms. The date at the top changes when we do, and the new version appears here and on tavolist.com at the same time.
If a change materially reduces your rights, we will tell you before it takes effect — in the app or by email — and you can stop using Tavo and ask Apple for a refund of the unused part of your subscription.
